PRIVACY POLICY FOR THE APP “WINTERCLASH WORLDWIDE” OF WINTERCLASH / JOHANNES JACOBI

1. SUBJECT OF THE DATA PROTECTION DECLARATION

In the following, we inform you about the handling of your personal data when using our app “Winterclash Worldwide” (hereinafter referred to as “App”) . Personal data in this context are all data with which you can be personally identified. Responsible for data processing in the App within the meaning of the General Data Protection Regulation (DSGVO) is Johannes Jacobi, Friedrichsberger Str. 8, 10243 Berlin, Germany, (hereinafter also referred to as “as” for short). The controller of personal data is the natural or legal person who alone or jointly with others determines the purposes and means of the processing of personal data.

2. COLLECTION AND USE OR TYPES OF DATA COLLECTED.

Full details of each type of personal data processed are provided in the designated sections of this Privacy Policy or selectively through explanatory text displayed prior to data collection.

Personal data may be provided voluntarily by the user or, in the case of usage data, may be collected automatically when this application is used.

Unless otherwise specified, the provision of all data requested by this application is mandatory. If the user refuses to provide the data, this may result in this application being unable to provide its services to the user. In cases where this application expressly states that the provision of personal data is voluntary, users may choose not to provide such data without any consequences for the availability or functioning of the service.

Users who are unclear about which personal data is mandatory may contact the Provider.

3. COOKIES

Any use of cookies – or other tracking tools – by this Application or third-party service providers used by this Application is for the purpose of providing the service requested by the User and any other purposes described in this document and, if any, in the Cookie Policy.


4. DEVICE ACCESS

Memory access
Access to the USB memory of the device is required to save or modify video or image material. This allows for the capture and storage of solved challenges / evidence images or video for challenge submission.

Camera access
Camera access is optional for challenge submission, but allows direct capture and submission of photo and video footage.

Microphone access
Microphone access is optional for challenge submission, but allows direct recording and submission of video footage with associated audio.

Device location
No device location is tracked and no motion profiles are created.

5. TRANSMISSION OF PERSONAL DATA
For participation in the Challenges, the personal transmission of data is required. The personal data is requested during registration via the Winterclash account (e-mail, name, password). In the app, a clear name can be replaced by a nickname.


6. DISCLOSURE OF PERSONAL DATA TO THIRD PARTIES
Without written consent of the participants, there will be no disclosure of personal data to third parties or use for advertising purposes. The following third-party services are used:

Push notifications
We use the services Expo (650 Industries Inc., 624 University Ave #1, Palo Alto, CA 94301, USA), Firebase Cloud Messaging by Google (Android) and Apple Push Notifications (iOS) for push notifications. In the process, Firebase and Apple generate a calculated key composed of the app’s identifier and its device identifier. This key is stored on our push-platform by with your chosen settings to provide you with the content according to your preferences. The Firebase or Apple servers cannot draw any conclusions about the requests of users or determine any other data related to a person. Firebase and Apple serve only as intermediaries. To be able to send you push notifications, we use the Technology Expo is used to uniformly distribute push notifications to Android and iOS.

Expo
In order to provide updates as quickly as possible, we use the so-called OTA update procedure, whereby the application always obtains the latest version of the application via the services of Expo (650 Industries Inc., 624 University Ave #1, Palo Alto, CA 94301, USA), which is used the next time the application is launched.


Sentry
To ensure that the content of our app is available as long as possible and to technically optimize our offer, we use the service Sentry (Sentry, 1501 Mariposa St #408, San Francisco, CA 94107, USA). Sentry processes app data that allows conclusions to be drawn about the availability of the app content, any technical anomalies, and code errors. For this purpose, requests from app users are recorded anonymously in order to identify sources of errors and problems. Sentry truncates the user IP address by the last two digits and thus stores the user data under a pseudonym. The pseudonymized data is deleted after seven days and aggregated data after three months. Due to our legitimate interest in the security, accuracy and optimal presentation of our app content as well as our online course content, we use Sentry in accordance with Art. 6 (1) lit. f DSGVO. Amazon Web Services
Our systems are hosted by Amazon Web Services Inc. (410 Terry Avenue North, Seattle WA 98109, USA). Due to our legitimate interest in providing our app content, we use the services of Amazon Web Services in accordance with Art. 6 (1) lit. f DSGVO. 7. YOUR RIGHTS

Insofar as the legal requirements are met in each case, you have the following rights:

You have the right to request confirmation from us as to whether personal data relating to you is being processed; if this is the case, you have a right to information about this personal data and the information listed in detail in Art. 15 DSGVO.

You have the right to demand that we correct any inaccurate personal data concerning you and, if necessary, complete any incomplete personal data without undue delay (Art. 16 DSGVO).

You have the right to demand that we delete personal data concerning you without undue delay if one of the reasons listed in detail in Art. 17 DSGVO applies, for example if the data is no longer required for the purposes pursued (right to erasure).

You have the right to demand that we restrict processing if one of the conditions listed in Art. 18 DSGVO applies, for example if you have objected to processing, for the duration of the review by us.

You have the right to object at any time to processing of personal data concerning you that is carried out for direct marketing purposes. You also have the right to object at any time, on grounds relating to your particular situation, to processing carried out on the basis of Art. 6(1) sentence 1 lit. e) or f) DSGVO (Art. 21 DSGVO). You will find a supplementary note on the right to object at the end of this privacy policy.

You have the right to revoke any consent you have given to us at any time with effect for the future (right of revocation).

You have the right to receive from us the data concerning you that you have provided to us in a structured, common and machine-readable format. You may also transfer this data to other entities or have it transferred by us (right to data portability).

10. DATA SECURITY
We also use technical and organizational security measures to protect personal data that is generated or collected, in particular against accidental or intentional manipulation, loss, destruction or against attack by unauthorized persons. Our security measures are continuously improved in line with technological developments.
Your personal data is also encrypted using SSL/TLS technology to prevent access by unauthorized third parties.

Note on the right to object:
You have the right to object at any time to processing of personal data concerning you that is carried out for direct marketing purposes. You also have the right to object at any time to processing that is carried out on the basis of Art. 6 (1) sentence 1 lit. e) or f) DSGVO for reasons that arise from your particular situation (Art. 21 DSGVO).

We will then no longer process the personal data for direct marketing purposes and otherwise only if we can demonstrate compelling legitimate grounds for the processing that override your interests, rights and freedoms, or if the processing serves to assert, exercise or defend legal claims.
